2) Acceptance of Terms

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

3) Purpose of the Site

The Site provides information and may allow you to manage or request lodging, experiences, spa, restaurant, and beach club services in Todos Santos, B.C.S. Some reservations are processed through third-party engines (see section 8).

4) Capacity and minimum age

To book services, you must be over 18 years old and have the legal capacity to do so. If you are booking for others, you confirm that you have their authorization. For lodging, the minimum check-in age is 18 (subject to booking engine policies). CloudBeds.com

5) Permitted use of the Site

You agree to: (i) not compromise the security or integrity of the Site; (ii) not engage in scraping or abusive automated use; (iii) not impersonate others or provide false information; (iv) respect copyrights, trademarks, and other applicable regulations.

6) Content, trademarks, and intellectual property

All text, images, logos, designs, photographs, audiovisuals, and software belong to Guaycura or third-party licensors. No licenses are granted other than those necessary for browsing. Photographs are for illustrative purposes; the specific room/table/space assigned may vary based on availability.

7) Information, availability, currency, and prices

Availability and the final price are confirmed in the booking engine and in your confirmation email. The hotel engine (ReservHotel) allows you to select a currency; the total and applicable currency are shown during the booking process. The Spa displays prices in MXN on the Site.

8) Reservations, third-party engines, and payments

8.1 Hotel. Lodging reservations are managed via ReservHotel. Their terms, cancellation policies, and payment processing apply additionally and, regarding the booking/payment process, take precedence in the event of a conflict. cloudbeds.com
8.2 Restaurants. Restaurant reservations are managed via OpenTable to ensure availability. OpenTable's terms apply to this process. guaycura.com
8.3 Spa and experiences. Reservations can be made on the Site or through channels indicated on each service page; specific conditions are displayed before confirmation. guaycura.com
8.4 Payment data. Processing is handled by the respective booking engine provider. We do not store card data beyond what is necessary to complete the transaction, except for tokenization permitted by the provider and consented to by you (e.g., for no-shows or damages).
8.5 Confirmation. Your reservation is finalized once the engine displays the confirmation and you receive the corresponding email.

9) Cancellations, changes, and no-shows

Policies vary by rate, date, and channel and are displayed before payment and in your confirmation.
– Non-refundable rates: No refunds or changes allowed, unless otherwise specified by the rate terms.
– No-show: The indicated fee may apply (up to 100% of the total, depending on the rate/channel).
– Modifications: Subject to availability, rate differences, and the original channel's rules. CloudBeds.com

10) Check-in, conduct, and additional charges

Check-in/Check-out: 2:00 PM / 12:00 PM, unless your confirmation states otherwise. A valid credit card may be required as a guarantee.
Conduct: We reserve the right to cancel services or request your departure if behavior puts people or facilities at risk or violates house rules.
Damages and replacements: You authorize charges for damages, lost keys, minibar items, consumption, or extraordinary cleaning based on current rates or actual replacement costs.

11) Minors, pets, smoking, and events

Policies regarding minors, cribs/extra beds, pets, smoke-free areas, and events are specified by property/service and are included in your confirmation.

12) Gift cards, codes, and promotions

Gift cards, coupons, and promotional codes: (i) are for personal use unless marked as "bearer"; (ii) are not redeemable for cash; (iii) are subject to validity periods, blackout dates, and participating services; (iv) cannot be combined unless otherwise stated; (v) may require beneficiary identification. Refunds or reversals will follow the rules of the specific promotion/rate.

13) Third-party links and services

14) Privacy and personal data

The processing of personal data is governed by the Privacy Policy published on the Site, which identifies HOTEL BOUTIQUE DE TODOS SANTOS, SA DE CV as the data controller, and provides the address, contact methods, and the procedure for exercising ARCO rights. guaycura.com

15) Warranties and limitation of liability

The Site is provided "as is." To the maximum extent permitted by law, we are not liable for: (i) loss of profit, loss of opportunity, or indirect damages; (ii) third-party failures (internet providers, booking engines, payment gateways); (iii) force majeure or acts of God. Nothing limits non-waivable consumer rights.

16) Force majeure

We may modify, reschedule, or cancel services when events beyond our reasonable control occur. We will strive to offer equivalent alternatives whenever possible, in accordance with the booked rate.

17) Changes to these Terms

We may update these Terms at any time. The current version is the one published on the Site, with the "Last updated" date. Changes apply from the date of publication and to new reservations/transactions.

18) Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of La Paz, Baja California Sur, Mexico, waiving any other jurisdiction that may apply.
